Welcome to MouCo Cheese Company (“MouCo,” “we,” “us,” or “our”). We operate this store and website (the “Services”) to help you shop our cheeses and related products. Our store is powered by Shopify. These Terms of Service (“Terms”) govern your access to and use of the Services and incorporate all policies referenced here, including our Privacy Policy and our Refund Policy and Shipping Policy.
By visiting or using the Services, you agree to these Terms and our policies. If you do not agree, you should not use the Services.
1. Access & Accounts
You represent that you are at least the age of majority in your jurisdiction or have consent from a parent/guardian. You may be asked to provide information (e.g., email, billing, shipping, and payment info). You warrant that the information you provide is accurate and that you have rights to provide it. You’re responsible for safeguarding your account credentials and for all activity under your account.
2. Our Products
We try to represent our products accurately online, but appearance (including color) can vary by device. Descriptions and availability may change at any time. We may limit quantities or discontinue items at our discretion.
3. Orders
Your order is an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and we confirm acceptance. Please review your order carefully—cancellations may not be possible after acceptance. Purchases are for personal/household use, not for resale or export. Returns and remedies are governed by our Refund Policy and shipping by our Shipping Policy.
4. Prices & Billing
Prices, discounts, and promotions may change without notice. The price charged is the price at checkout and in your confirmation email, excluding taxes, shipping, handling, customs, or import fees unless stated. You agree to keep your account, contact, and payment details current and accurate and authorize charges for your order (plus applicable taxes and fees).
5. Shipping & Delivery
Estimated delivery times are not guaranteed. Risk of loss passes to you when we transfer products to the carrier. Carrier delays and events outside our control may affect delivery. 6. Intellectual Property
The Services and their contents (text, images, logos, graphics, video, audio, design/layout, and selections) are owned by MouCo or our licensors and protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. No rights or licenses are granted except as expressly stated. MouCo names, logos, and related marks are trademarks of MouCo or our affiliates. Shopify’s marks are the property of Shopify. Other marks belong to their owners.
7. Optional Tools
We may provide access to third-party tools “as is” and “as available,” without warranties or endorsement. Use them at your own discretion and review the third party’s terms.
8. Third-Party Links
The Services may link to third-party sites or content. We are not responsible for, and do not endorse, third-party content or practices. Review their policies before transacting.
9. Relationship with Shopify
Our store runs on Shopify. Purchases are made directly from MouCo, not Shopify. You agree that Shopify is not responsible for your transactions with MouCo.
10. Privacy
Your use of the Services is subject to our Privacy Policy. Because our store is hosted by Shopify, certain personal information is processed by Shopify to operate and improve the Services. See our Privacy Policy for details.
11. Feedback
If you submit reviews, ideas, or other content (“Feedback”), you grant MouCo a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, and display that Feedback for any purpose, subject to applicable law. You represent you have the rights to provide the Feedback and that it complies with these Terms.
12. Errors & Omissions
Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, or availability). We may correct or update information or cancel orders if information is inaccurate, at any time without prior notice.
13. Prohibited Uses
You agree not to misuse the Services, including violating laws, infringing IP, harassing others, transmitting malware, scraping, or attempting to circumvent security. We may suspend or terminate access for violations.
14. Termination
We may suspend or end your access at any time. Sections that by nature should survive (e.g., IP, Feedback, Disclaimers, Limitations, Indemnities, Governing Law) will continue to apply.
15. Disclaimers
EXCEPT AS EXPRESSLY STATED BY MOUCO, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT). Some jurisdictions do not allow certain disclaimers; those may not apply to you to the extent prohibited by law.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MOUCO AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR SIMILAR DAMAGES (INCLUDING LOST PROFITS, DATA, OR REPLACEMENT COSTS) ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for all claims shall not exceed the amount you paid to MouCo for the product giving rise to the claim.
17. Indemnification
You agree to indemnify and hold harmless MouCo and our affiliates, officers, directors, employees, agents, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted.
19. Waiver; Entire Agreement
Failure to enforce a right is not a waiver. These Terms (plus policies referenced) are the entire agreement between you and MouCo regarding the Services and supersede prior understandings.
20. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms without notice.
21. Governing Law
These Terms and any related disputes are governed by the laws and courts of the U.S. state where MouCo is headquartered, without regard to conflict-of-law rules. You consent to personal jurisdiction and venue in those courts.
22. Headings
Headings are for convenience only and do not affect interpretation.
23. Changes to These Terms
You can review the latest version of these Terms on this page. We may update them by posting a revised version. Material changes will be communicated as required by law. Your continued use of the Services after changes become effective constitutes acceptance.

By opting in to SMS from MouCo, you agree to receive text messages (e.g., order alerts, limited-time updates about fresh curds, and occasional marketing). Message frequency varies. 26. Trademarks
Our name and the cheeses we craft represent years of work, care, and character. To protect that identity and the integrity of our brand, MouCo®, Ashley®, ColoRouge®, Truffello®, PepBert®, and Boo®, along with all related logos, designs, and slogans displayed on this site, are trademarks or registered trademarks of MouCo Cheese Company in the United States and other jurisdictions. These marks may not be used, copied, or reproduced without our written permission. Other product names, logos, and company names mentioned on the Services are the property of their respective owners. Nothing in these Terms grants you any right or license to use any trademark displayed on the Services without prior written consent from MouCo Cheese Company.
